Terms of Service

These terms govern your use of DepositDesk (the “app”), a Shopify application provided by Skeg Software, a sole proprietorship operated by Justin Breshears. By installing or using the app, you (the “merchant”) agree to these terms.
1. The service
DepositDesk lets a merchant offer deposit and partial-payment options on orders: the customer pays a deposit at checkout, and the app schedules and automatically collects the remaining balance through Shopify at the agreed time. Along the way it emails the customer a deposit confirmation with the balance and scheduled charge date, and declined-payment, action-required, or card-removed notices if a charge cannot be collected (Shopify may also send a secure card-update link on our request), and it alerts us if a background job needs attention.
2. Payment processing
DepositDesk does not process payments and is not a payment processor, money transmitter, or merchant of record. All charges are executed by Shopify against the payment method the customer authorized at checkout. We instruct Shopify to capture the balance; Shopify handles the money and the card data.
3. Your responsibilities
- Configure deposit plans accurately and present clear deposit and balance terms to your customers before they check out.
- Use the app lawfully and in compliance with the Shopify Terms of Service, Shopify’s payment terms, and all applicable consumer-protection, tax, and privacy laws.
- Act as the data controller for your customers’ personal data and obtain any consents required for the deposit arrangement.
- Keep your store and billing in good standing with Shopify.
4. Fees
DepositDesk offers a single Pro plan at a flat US$29 per month, with a 14-day free trial, no per-transaction fees, and no order-value cap. Fees are billed through Shopify’s managed app billing and are subject to Shopify’s billing terms. We may change pricing on prospective notice; continued use after a change means you accept it.
5. Availability & “as is”
We work to keep the app reliable and to capture balances on schedule, but the app is provided “as is” without warranties of any kind. We do not guarantee that any specific payment will succeed — a capture can fail for reasons outside our control (an expired or revoked card, insufficient funds, a Shopify or bank outage). You remain responsible for following up on balances the app cannot collect.
6. Limitation of liability
To the maximum extent permitted by law, Skeg Software is not liable for any indirect, incidental, or consequential damages, or for lost revenue or uncollected balances. Our total liability for any claim relating to the app is limited to the fees you paid us for the app in the twelve months before the claim.
7. Data protection
Our handling of personal data is described in our Privacy Policy, which forms part of these terms. In that relationship you are the data controller and Skeg Software is your data processor, acting on your instructions, using the sub-processors listed in the Privacy Policy, and deleting store data after uninstall as described there.
8. Termination
You may stop using the app at any time by uninstalling it from your Shopify admin; doing so ends these terms and triggers deletion of your store’s data as described in the Privacy Policy. We may suspend or terminate access for violation of these terms or misuse of the app.
9. Changes to these terms
We may update these terms; when we do, we will revise the date above. Material changes will be communicated where appropriate.
10. Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules.
